- ensure that any information you provide to us is accurate and kept up to date.
You must not:
- use RYDAR, the App, or the Services in a way that endangers you, other road users, pedestrians, passengers, or property;
- copy, modify, adapt, translate, decompile, reverse engineer, disassemble, tamper with, or misuse the App, RYDAR software, firmware, or Services except to the extent permitted by law;
- attempt to gain unauthorised access to the App, RYDAR, our systems, data feeds, servers, accounts, or networks;
- use the Services to transmit malicious code, interfere with service availability, or compromise security;
- share inaccurate, unlawful, misleading, harmful, or malicious road, traffic, or hazard information; or

7. Account Registration and Security
To access full functionality, you may need to create an account or pair the App with RYDAR.
You agree to:
- provide accurate, current, and complete account information;
- keep your login details, passwords, and account credentials secure;
- notify us promptly if you become aware of unauthorised access or use of your account; and
- take responsibility for activity carried out through your account unless the activity is caused by our failure to use reasonable care and skill.
We may require you to verify your account, reset your password, or re-authenticate where reasonably necessary for security, fraud prevention, or service protection.
8. RYDAR and App Functionality
RYDAR and the App may provide functionality including:
- speed-limit alerts;
- speed-camera, enforcement-location, or road-hazard notifications;
- location-based driver-assistance services;
- device pairing and settings;
- software, firmware, or app updates; and
- customer support and service messages.
The Services may rely on GPS signals, mobile network coverage, Bluetooth, device sensors, operating-system permissions, user settings, third-party data sources, map providers, and other external systems. These may be unavailable, inaccurate, incomplete, delayed, or affected by your device, vehicle, location, weather, signal conditions, or third-party service availability.
Alerts are provided for convenience and assistance only. They should not be treated as complete, real-time, official, or guaranteed road-safety or enforcement information.
9. Third-Party Data, Mapping, GPS, and User-Generated Information
Some features may depend on Third-Party Data. We do not control all third-party data sources and cannot guarantee that they will be complete, accurate, up to date, or available at all times.
- Speed limits, road layouts, restrictions, enforcement locations, hazards, and traffic conditions may change without notice.
- GPS location may be inaccurate or unavailable, particularly in tunnels, built-up areas, car parks, rural areas, poor signal areas, or where your device settings restrict location access.
- User-submitted alerts or community information, where available, may be incorrect, duplicated, delayed, incomplete, or misleading.
- You must always use your own judgement and follow road signs, signals, traffic laws, and the instructions of police, emergency services, and enforcement authorities.
10. Service Availability
We aim to provide a reliable service, but we do not guarantee:
- uninterrupted access;
- error-free operation;
- availability of all features at all times;
- real-time accuracy of alerts;
- compatibility with every vehicle, phone, operating system, network, or device; or
- continued availability of any particular feature, data source, or third-party service.
We may, where reasonably necessary:
- update, modify, improve, suspend, restrict, or withdraw the App, RYDAR software, data feeds, or Services;
- perform maintenance, security updates, or technical changes;
- suspend access to protect users, the Services, our systems, or third parties; or
- withdraw features that are no longer available, lawful, commercially viable, secure, or supported.
11. Software Updates, Compatibility, and Changes
We may provide updates to the App or RYDAR software or firmware from time to time. Updates may include security, compatibility, performance, bug-fix, legal-compliance, data, or feature updates.
- Some features may not work correctly if updates are not installed.
- We may require a minimum mobile operating-system version, Bluetooth capability, location permission, data connection, or other technical requirements.
- We are not responsible for issues caused by unsupported devices, outdated operating systems, disabled permissions, poor signal, third-party platform changes, or unauthorised modifications.
Your download and use of the App may also be subject to the applicable terms, rules, and policies of the Apple App Store, Google Play Store, or any other platform through which the App is made available.
12. Warranty, Returns, and Consumer Rights
Your statutory rights are not affected by this Agreement, including your rights under the Consumer Rights Act 2015.
If the RYDAR device is faulty, not as described, not of satisfactory quality, or not fit for purpose, you may be entitled to a repair, replacement, refund, price reduction, or other remedy under applicable consumer law.
App-related issues may be addressed through updates, troubleshooting, compatibility advice, customer support, or other remedies required by applicable law.
Nothing in this Agreement excludes or limits any statutory rights or remedies that cannot lawfully be excluded or limited.
13. Limitation of Liability
Nothing in this Agreement limits or excludes our liability for:
- death or personal injury caused by our negligence;
- fraud or fraudulent misrepresentation;
- breach of any statutory rights or obligations that cannot be excluded or limited; or
- any other liability that cannot be excluded or limited under applicable law.
Subject to the above, and to the fullest extent permitted by law, DSL shall not be liable for:
- indirect, consequential, special, incidental, or punitive losses;
- loss of profits, revenue, business, goodwill, anticipated savings, opportunity, or data;
- fines, penalties, prosecutions, legal consequences, collisions, incidents, or losses arising from your failure to comply with road traffic laws or your reliance on alerts;
- inaccurate, delayed, missing, incomplete, unavailable, or incorrect alerts, data, GPS, mapping, speed-limit, enforcement-location, traffic, or hazard information;
- losses caused by third-party data sources, mobile networks, app stores, operating systems, device manufacturers, vehicles, GPS, Bluetooth, or other external systems; or
- losses caused by your misuse, unsafe installation, unauthorised modification, failure to update, disabled permissions, or use outside applicable legal requirements.
We provide the Services using reasonable care and skill. However, RYDAR, the App, and the Services are assistance tools and are not guaranteed to prevent speeding, road traffic offences, fines, collisions, hazards, or other incidents.
14. Data Protection and Privacy
14.1 Data Controller
DSL Group (Nottingham) Limited is the data controller for personal data processed in connection with your account, the App, RYDAR, and the Services, unless stated otherwise in our Privacy Policy.
14.2 Privacy Policy
Our Privacy Policy explains in more detail how we collect, use, store, share, protect, and retain personal data. You should read the Privacy Policy before using the App, RYDAR, or the Services.
14.3 What Data We May Collect
We may collect and process personal data including:
- name and contact details;
- account information and login details;
- device information, such as device model, operating system, app version, RYDAR identifier, and device identifiers;

- location data, where required for location-based features and where permitted by your device settings and applicable law;
- purchase, subscription, entitlement, or warranty information, where applicable; and
- marketing preferences and communication records.
14.4 How We Use Your Data
We may use your data to:

- provide customer support, troubleshooting, service messages, and account communications;
- process purchases, subscriptions, returns, warranties, or service entitlements, where applicable;
- detect misuse, fraud, security issues, or technical faults;
- comply with legal obligations; and
- send marketing communications only where permitted by law and where you have opted in or where another lawful basis applies.
14.5 Legal Basis
Depending on the processing activity, we may process your data under one or more lawful bases, including:
- contract, where processing is necessary to provide the App, RYDAR, the Services, support, purchases, or account functionality;
- legitimate interests, such as improving, securing, analysing, and supporting the Services, provided your rights and interests do not override those interests;

- legal obligation, where we must process information to comply with law, accounting, tax, consumer, safety, regulatory, or dispute obligations.
14.6 Location Data

Where consent is used as the lawful basis for optional location features, you may withdraw that consent at any time. Withdrawal will not affect the lawfulness of processing carried out before consent was withdrawn.
14.7 Data Sharing
We may share personal data with:
- technology partners, hosting providers, analytics providers, support providers, app platforms, payment providers, and other service providers acting as processors or independent controllers, as applicable;

You can unsubscribe from marketing communications at any time using the unsubscribe link in the message or by contacting us. Service, safety, account, support, legal, and transactional messages are not marketing messages and may still be sent where necessary.
16. Intellectual Property
All intellectual property rights in RYDAR, the App, the Services, software, firmware, data, databases, content, design, branding, logos, trade marks, graphics, documentation, and related materials are owned by DSL or its licensors.

- we are required to do so by law, a regulator, court, app platform, or service provider; or
- we discontinue the App, Services, or relevant functionality.
You may stop using the App, RYDAR, and the Services at any time. You may also request account deletion, subject to our need to retain certain information where required or permitted by law.
Termination does not affect rights and obligations that have already arisen or clauses intended to continue after termination, including clauses relating to safety, lawful use, intellectual property, liability, privacy, governing law, and dispute resolution.
18. Changes to This Agreement
We may update this Agreement from time to time, for example to reflect changes to the App, RYDAR, the Services, legal requirements, data sources, safety information, or business operations.
Where changes are material, we will take reasonable steps to notify users, such as by App notification, email where applicable, website notice, or other appropriate means.
